Baehr v. Lewin

In Baehr v. Lewin, 852 P.2d 44 (Hawaii 1993), the Hawaii Supreme Court held that Hawaii must offer same-sex marriage licenses based on its state Equal Rights Amendment, which requires "equality ... on account of sex."

The people of Hawaii then passed a constitutional amendment in 1998 to override this decision and prohibit same-sex marriage licenses.
