In Clark v. Columbia/HCA Info. Servs., 25 P.3d 215 (Sup. Ct. Nev. 2001), the Nevada Supreme Court denied HCQIA immunity to the hospital HCA for revoking a physician's privileges based upon the pretext of disruptive behavior by the physician.
