Kentucky Perpetuities Act

The Kentucky Perpetuities Act (1960) requires that any owner who placed a condition on a conveyance of property known as a “possibility of reverter,” must periodically record his interest with the county clerk or else lose it. KRS § 381.221. No notice was ever given to property owners of this new legal requirement.

This was applied to invalidate a reversion in Black Mountain Energy Corp. v. Bell County Bd. of Educ., 206 U.S. Distr. LEXIS 91786 (E.D. Ky. Dec. 19, 2006).
