In Lee v. Trinity Lutheran Hosp., 408 F.3d 1064 (8th Cir. 2005), the U.S. Court of Appeals for the Eighth Circuit held that HCQIA provided immunity for money damages and thereby dismissed claims for defamation and breach of contract by a physician who lost her privileges to practice the defendant hospital.
