In Lubin v. Crittenden Hospital Ass'n, 295 Ark. 429 (Ark. 1988), the Arkansas Supreme Court rejected a claim by a physician that his rights of due process and equal protection of the law had been violated by a private hospital conducting peer review.
The Court assumed, without deciding, that medical staff by-laws constitute a contractual obligation.
