In Mt. Vernon-Woodberry Cotton Duck Co. v. Alabama Interstate Power Co., 240 U.S. 30 (1916), the U.S. Supreme Court held that the power of eminent domain allows the sovereign to transfer private property to private parties, often common carriers, who make the property available for the public's use--such as with a railroad, a public utility, or a stadium.
The Court affirmed a state court decision in favor of jurisdiction for a power company with respect condemnation proceedings against a private owner.
