In Nelson v. Wal-Mart Stores, Inc., 245 F.R.D. 358 (E.D. Ark. 2007), a federal district court partly certified a class action against Wal-Mart for employment discrimination in allegedly failing to hire applicants based on their race.

Specifically, plaintiffs were African American truck drivers who sued under Title VII after being rejected for positions as truck drivers.
