In Patel v. Midland Memorial Hospital and Medical Center the U.S. Court of Appeals for the Fifth Circuit affirmed summary judgment against a physician who challenged a peer review decision. The Court agreed with the district court's denial of the physician's claims on the merits, and did not reach the issue of whether the HCQIA provided immunity to the defendant hospital and defendant physicians.

Judge Emilio Garza wrote the decision, which Judges Edith Jones and Carl Stewart joined.
