Abortion Pain Prevention Act

The Abortion Pain Prevention Act was passed and signed into law in Nebraska in April 2010 in order to prohibit abortions after 20-weeks of gestation, because research has shown that unborn children feel pain from abortion during that period.

The Act generated national publicity, which often omit how the vote was an overwhelming 44-5 in favor of the bill in Nebraska's unicameral legislature.[1]

Abortion providers promised to sue to try to overturn the law, which is scheduled to take effect in October 2010.

Some contend that the Act violates the ruling in Roe v. Wade (1973), which established a right to abortion based on viability without regard to evidence of fetal pain. But Roe v. Wade did not prevent States from protecting unborn children against fetal pain.
