In Golan v. Holder, 565 U.S. 302, 132 S. Ct. 873 (2012), a 6-2 U.S. Supreme Court upheld a congressional statute based on an international law, which had the effect of removing material from the public domain and subjecting it to Copyright Act protection.
Justices Breyer and Alito jointly dissented, and Justice Kagan did not participate.
