In Abood v. Detroit Bd. of Ed., 431 U.S. 209, 235-236 (1977), the U.S. Supreme Court held that public-sector unions are constitutionally prohibited from using the fees of objecting nonmembers for ideological purposes that are not germane to the union's collective-bargaining duties. Justice Potter Stewart delivered the opinion of the court, joined by Justices William Brennan, Byron White, Thurgood Marshall, William Rehnquist, and John Paul Stevens. Justices Lewis Powell (joined by Justices Warren Burger and Harry Blackmun), Rehnquist, and Stevens filed concurring opinions. Justice Powell was highly critical of the reasoning of the majority opinion.
