In Bowles v. Russell, 127 S. Ct. 2360 (2007), a 5-4 U.S. Supreme Court overturned a precedent and imposed a strict jurisdictional requirement on the power of the Court of Appeals to hear an appeal: the deadline for filing an appeal cannot be extended by the district court. Justice Clarence Thomas wrote the decision for the Court in this case, which concerned the jurisdiction to hear an appeal with respect to a habeas corpus petition relating to a conviction for murder.

Justice Clarence Thomas delivered the opinion of the court, joined by Justices John Roberts, Antonin Scalia, Anthony Kennedy, and Samuel Alito. Justice David Souter (joined by Justices John Paul Stevens, Ruth Bader Ginsburg, and Stephen Breyer) filed a dissenting opinion.
