The Kavanaugh smear of 2018 is an unsubstantiated slander against Judge Brett Kavanaugh made by liberals and anti-originalists upset of the prospect of losing the U.S. Supreme Court for the first time since 1934. In particular, Democrats were hysterical at the possibility of a pro-life majority on the Supreme Court.[1] The smears and left-wing tactics to defeat Kavanaugh could have a very negative long-term impact on U.S. politics.[2]

The strategy was first mapped out in July 2018 by Ricki Seidman, who orchestrated the 1991 Clarence Thomas smear and who advised at least one of Kavanaugh's accusers:
"Over the coming days and weeks there will be a strategy that will emerge, and I think it’s possible that that strategy might ultimately defeat the nominee."[3]
Like the attack on Justice Thomas, outrageous last-minute personal smears were intended to force extended, controversial, divisive, and unresolved hearings leading up to the 2018 Midterm elections. All of the people making the allegations hired partisan Democrat donors and operatives to help their efforts.[4]

The subsequent allegations were predictable, considering the intense opposition to the nomination by liberals and anti-Trumpers. Rather than being interested in the facts, liberals are trying to destroy the nomination of an originalist jurist even if it means destroying the life of the judge and his family.[5] Democrats have other methods of destroying the nomination if the subsequent unsubstantiated allegations fail to gain traction.[6] So far, Judge Kavanaugh has refused to allow Democrats to succeed in intimidating him into withdrawing his nomination.[7][8] Every witness named by both Blasey Ford and Ramirez has denied any event actually occurred.[9]

Explanation of process

Typically in the nomination process, citizen input is invited by contacting your local congressional Representative's office to voice support or opposition. If the citizen' input appears to carry some weight, a University Professor or member of a civic organization for example, the citizen may be refered to the Senator's office who ultimately votes on confirmation. If the Senator deems the information useful to the Committee vetting process, the Senator may ask for a letter in writing identifying who and what the qualifications are of the person making the statement, and a message to the Committee. These letters then are usually placed into the record en masse under unanimous consent agreements, although some people with personal, relevent knowledge may be called to testify. This citizen involvement typically ranges from enthusiastic support to benign objection.

If the Senator from the home state of the letter writer does not serve on the Committee, the Senator passes along the letter to the Committee. This is a routine process for all positions requiring Senate confirmation. Not all citizen involvement is screened or suppressed on a partisan basis by the Senators. Bi-partisan cooperation is, in fact, more common than most people are willing to admit; a Senator from a solid Blue state for example, may be willing to trade their vote across the isle for federal judges in Red states to gain support for a nominee more favorable to them in their home Blue state.

Occasionally Senators may take interest in a letter, and ask for a sworn statement; a controversial letter may escalate up to a request to testify or subpoena. It is not uncommon at all for partisans to impugn a nominee's character, especially if a personal relationship existed. It was at this step in the Anita Hill, Blasey Ford, and other cases related to Kavanaugh, Democrat staffers illegally leaked the unvetted information, putting public pressure on the letter writer to make sworn statements, and even testify. A person of some stature, a college professor for example (as Anita Hill and Blasey Ford are), then may feel compelled to give questionable or suspect testimony to mitigate damage to their reputation, having no idea at the start of the process they may be thrust into the limelight against their will.

Blasey Ford/Feinstein allegation

The first allegation is a claim that Kavanaugh tried to assault Christine Blasey Ford, who would later go on to become a far-left[10] university professor in California. Ford never told anyone about her allegation until soon after The New Yorker published in March 2012 that Kavanaugh was most likely the next nominee if a Republican were to win the upcoming presidential election[11] – other media sources discussed him around the same time.[12] Within a few months, Ford for the first time allegedly told her therapist an attempted assault occurred at a drinking party when she was in high school. The therapist did not include names of the boys in notes from the sessions. The notes are said to allege there were four boys present. However, an anonymous letter to the Washington Post in 2018 said there were only 2 boys present in a room. The following day Blasey Ford identified herself as the accuser.

Several factors[13] point to Ford's allegations against Kavanaugh being false:

  • Despite knowing of the allegations against Judge Kavanaugh for several weeks and having the opportunity to get to the truth during the regular hearings, Senate Democrats stayed silent about them until the last possible moment.[14] Afterward, they refused to hold a fair hearing, opting instead to abandon due process and consider Kavanaugh guilty with no evidence[15] – some of them cited his pro-Constitution judicial philosophy as for why he was supposedly guilty.[16] Many liberals even suggested Kavanaugh and the GOP, in general, were guilty because of being "white men."[17][18] Democrats ignored[19] the numerous threats made against Kavanaugh and his family,[20][21] and some Democrats mocked the threats made against swing-vote Senators.[22] They even considered impeaching Kavanaugh in the event of him being confirmed.[23] Predictably, some mainstream media outlets did not devote any airtime to the large amount of evidence supporting Kavanaugh.[24] Some Democrats fundraised off the allegations.[25][26]
  • Dozens of women who knew Kavanaugh well as early as his time in high schools have attested to him being very respectful toward women.[27] Every alleged witness that Ford named affirmed that the event did not happen or that they had no knowledge of it, including Ford's left-wing friends,[28] and when Ford claimed to have found four "witnesses" to corroborate her allegation, they really only were people that Ford had told of the allegation decades later.[29] Meanwhile, despite Democrats obsessing over the allegations, they defended people useful to their cause such as Bill Clinton,[30] Harvey Weinstein, Cory Booker,[31] and Keith Ellison,[32] as well as taking money from woman-abusers[33] (see also: Left-wing war on women). Real victims of rape, such as Juanita Broaddrick, disputed Ford's account.[34]
  • Despite claiming to want to testify, Ford balked when Senate Republicans actually tried to find a time for her to come, and then she demanded outrageous and unprecedented conditions in order to attend.[35] This was in order to delay any votes on Kavanaugh's confirmation as far into the future as possible.[36] Ford's lawyers also refused to cooperate with the Senate judiciary committee, missed deadlines to respond, and kept asking for more time.[37][38] This was despite the fact that Senate Judiciary Committee Chairman Chuck Grassley was extremely generous in trying to accommodate Ford.[39]
  • Ford hired prominent Democrat operative Ricki Seidman – who worked for Bill Clinton, Joe Biden, and Barack Obama – to advise her after the allegation was made public.[40] Earlier, Seidman publicly stated that she and other Democrats were plotting to destroy Kavanaugh's nomination once it was announced in July 2018.[41] Additionally, two of Ford's attorneys agreed after the allegations became public to headline a fundraiser for Democrat Senator Tammy Baldwin, though they canceled it once their plans became known to the public.[42] One of the main attorneys – Debra Katz, a Democrat donor who defended Bill Clinton and Al Franken[43] – representing Ford publicly made statements opposing President Trump earlier in his term.[44] Ford's attorneys were recommended to her by Dianne Feinstein,[45] and they did a poor job representing her.[46]
  • Ford and Senate Democrats demanded that the FBI investigate her allegations – however, the allegation did not involve a federal crime,[47] was too vague and far into the past for an FBI investigation to be of any value, and Congress traditionally investigates such matters. Sen. Joe Biden explained the usefulness of FBI investigations.[48]
  • Ford and her lawyers refused to reveal who paid for the polygraph test – a notoriously unreliable method of determining whether one is telling the truth – she allegedly took and how it was conducted – essential questions to determine how seriously to take its findings.[49] When she finally released it on September 26, 2018, investigators found several inconsistencies in it – not to mention that polygraph tests do not prove anything.[50][51][52] However, she continued to refuse to hand over her therapist notes to the Judiciary Committee.[53]
  • Ford's yearbooks show that she and her friends willingly supported the promiscuous, drunken, and racist culture at her school.[54]
  • Ford admitted to not knowing many details of the alleged incident, even including how many people were involved.[55] Even after she went public about the allegations, important details of the alleged incident changed.[56]
  • Ford claimed to be afraid of flying because of the alleged incident[57] – giving her an excuse to delay the hearings as she drove from California from Washington, D.C., but she has family on the east coast, and he did graduate work in Hawaii, revealing an inconsistency in her account.[58] When the details of the polygraph test were released it was found it was administered in Maryland, meaning it was likely Ford flew there and back.[50][51] At her Senate hearing, she admitted she did a lot of flying despite her previous claim.[59]
  • Kavanaugh took detailed calendar notes, and his calendar for the summer of 1982 do not describe any party as the one Ford described.[60]
  • The Kavanaugh allegations were first reported on by The Washington Post, a left-wing newspaper which published similar accusations against conservative such as Donald Trump in 2016 and Roy Moore in 2017.
Committee Counsel Rachel Mitchell, who examined Dr. Ford, concluded:
A “he said, she said” case is incredibly difficult to prove. But this case is even weaker than that. Dr. Ford identified other witnesses to the event, and those witnesses either refuted her allegations or failed to corroborate them.... I do not think that a reasonable prosecutor would bring this case based on the evidence before the Committee. Nor do I believe that this evidence is sufficient to satisfy the preponderance-of-the-evidence standard.[61][62]

Feinstein confidentiality and rules violations.

A Feinstein staffer was reported to have leaked the Kavanaugh smear. It wasn't the first scandal involving Feinstein and staffers in the twilight of her career. Feinstein did not recuse herself or report a conflict of interest while the Committee was investigating who employed FusionGPS as an ex-Feinstein staffer took over paying FusionGPS to promote the Trump-Russia smear. Most amazing of all, even the California Democratic Party is fed up with Feinstein's corruption and refused to endorse her for re-election.

Dianne Feinstein, who facilitated publication of the letter and violated a confidentiality agreement with Ford by leaking to the mainstream media, told The Hill, "I don't know if everything is truthful."[63]

Feinstein met for a private interview with Judge Kavanaugh on August 20, knew of Blasey Ford's allegations for three weeks, did not ask Kavanaugh about the allegations, did not inform the committee or ask the FBI to investigate, violated committee rules and process by leaking confidential information,[64][65] and had already recommended an attorney who, as in the Michael Cohen/Stormy Daniels and Perkins Coie/FusionGPS cases, paid for Blasey Ford's polygraph test to mask the identity of the client.[66] While the fake news media ran with stories for a week that Blasey Ford "passed" a polygraph exam, in fact, it was revealed during the hearings the polygraph examiner never asked her about Judge Kavanaugh.[67]

Feinstein's underhanded ploy betrayed Blasey Ford's confidence, forcing her to testify in public against her will,[68] and was largely viewed as payback for Republicans refusing to hold hearings on the Merrick Garland nomination.

Sen. Lindsey Graham called for an investigation into Feinstein's misconduct.[69] According to a reporter from The Federalist, "Feinstein staffer Heather Sawyer leaked Ford’s letter to the media in violation of Senate Rule 29(5)."[70] The rule states, "Any Senator, officer, or employee of the Senate who shall disclose the secret or confidential business or proceedings of the Senate:
If the offending party is a Senator they are to be punished with "expulsion from the body" and "if an officer or employee, to dismissal from the service of the Senate, and to punishment for contempt."

The extraordinary rule violation by Democrats to force extended hearings was not the first violation in the Kavanaugh hearings – Sen. Cory Booker, likewise admitted to violating the rule early in the hearings.[71] In fact, it was a violation of this same rule that forced the extended Anita Hill hearings in 1991, in which former Vice President Joe Biden then and now was accused of racism, despite being nominated by his party to fill the second highest office in the land.[72]

Blasey Ford, like Anita Hill, was a victim of vicious partisan Democrats seeking to stop a Supreme Court nomination. Both signed letters to be inserted into the record by unanimous consent agreements along with dozens of others in opposition, neither really prepared to attest under oath to the garbage they were asked to write by Democrats.

Liberal hypocrisy

Liberal hypocrisy was on display throughout the extended session, but nowhere did it provide more comic relief than in the questioning of Kavanaugh by Sen. Richard Blumenthal. Blumenthal asked if the judge was familiar with the jury instruction, "falsus in uno, falsus in omnibus"—"false on one thing, false on all."[73] Blumenthal had for 15 years claimed to have served in Vietnam, during the Vietnam war, to promote himself and his political career until he was forced in 2010 to admit to the lie. The Stolen Valor Act of 2013 now provides penalties for military imposters.

Blumenthal went on to demean a constituent – naming her by name before a nationally televised audience – as a promiscuous tramp in high school in an effort to attack Kavanaugh.

Doxxing

During the hearings, the home addresses and personal phone numbers of Republican Senators were published online from IP addresses originating within the U.S. House of Representatives.[75] The privacy rights violations are suspected to originate from Democratic congressional staffers.[76] The illegal doxxing is said to have originated with the staff of Rep. Maxine Waters.

New Yorker allegation

The mainstream media brought up a second allegation because "Senate Democrats began looking."[77] It was first reported in the New Yorker during the period in which the Senate Judiciary Committee delayed their vote – Judge Kavanaugh also completely denied it. The allegation was brought by a classmate of Kavanaugh at Yale who majored in sociology and psychology and who then worked in the often-liberal field of domestic violence. "After six days of carefully assessing her memories and consulting with her attorney,"[78] she claims that at a party in which she herself was drinking, Kavanaugh exposed himself to her.[79] The allegation had several problems, though that did not matter to Democrats, bent on destroying Kavanaugh and originalism in general.[80] The New Yorker wrote:
"The magazine contacted several dozen classmates of Ramirez and Kavanaugh regarding the incident...The New Yorker has not confirmed with other eyewitnesses that Kavanaugh was present at the party."
The accuser did give the New Yorker six names to support her claim. Six witnesses Deborah Ramirez stated could substantiate her accusation. And when the New Yorker interviewed them, all six said it never happened, 100% of the evidence discovered by the New Yorker refuted the claim, yet the New Yorker still published the article. Not only were the allegations unsubstantiated, but Ramirez's classmates denied the story.[81][82] The New York Times did its own investigation and could not corroborate the story.[83][84] Critics criticized the New Yorker for its poor, low-quality reporting on this allegation,[85][86][87] and they noted that the article actually refuted the allegations.[88]

Ramirez reportedly refused to cooperate with the Senate Judiciary Committee.[89]

Later, NBC News again made false and uncorroborated claims, reporting that Kavanaugh had potentially known about the allegation before it was revealed because he had possibly contacted others to ask them to refute the claim, but it later – and silently – corrected the original article to show that he had actually found out about the allegation early because Ramirez had contacted others.[90]

Beer smear

After Democrats realized the Ford smear was not going anywhere, they tried to paint Judge Kavanaugh as a heavy drinker.[91][92] Several of Kavanaugh's college friends have denied these smears.[93]

In trying to prove that Kavanaugh was a violent drunk, The New York Times wrote a weak story about a police report that Kavanaugh threw ice at someone in a bar in the mid-1980s. Not only did the report show no charges were filed, that someone else threw a glass at the same person, and that Kavanaugh willingly presented himself for questioning, but the NYT article was written by someone who had explicitly announced her public opposition to Kavanaugh.[94][95]

Seventh FBI investigation

Judge Kavanaugh has undergone six FBI background checks during his career in public service.

Sen. Jeff Flake, on behalf of Senate Democrats and as a condition to vote in the affirmative in Committee and on the final confirmation, requested FBI interviews with relevant parties. President Trump ordered an FBI investigation, limited in scope to be completed in one week. Almost immediately, corrupt elements in the FBI, again, began illegal leaking to the Washington Post, as in the Carter Page FISA abuse scandal, to manipulate public opinion and elections.[96]

Other smears

Another allegation reported by NBC News on the eve of the hearing was debunked.[97][98] In this accusation, Republican Sen. Cory Gardner of Colorado followed the rules of the Senate and process. Unlike Feinstein, Gardner shared the written allegation with the Committee. Evidence suggests Democrats or staffers then illegally leaked the unsubstantiated allegation to NBC News. Sen. Lindsey Graham noted NBC News was a co-conspirator in the destruction of Kavanaugh.[99]The person who the letter claimed Kavanaugh assaulted refuted the claim before being asked to give a sworn statement to the Committee.[100] The illegal leak will be investigated.

In the Rhode Island case, a frivolous allegation was reported by an alleged witness who made a sworn statement to the Committee, which he later retracted. The accuser was referred for criminal investigation for making false sworn statements to the Senate Committee on the Judiciary.[101]

Avenatti brouhaha

Democratic presidential candidate Michael Avenatti all week long before the extra hearing publicly announced that he was in contact with an anonymous accuser who claimed Kavanaugh participated in drug-induced gang rapes. Avenatti promised to bring forward the accuser before the Thursday hearing. The story was repeated by ABC News, CBS News, USA Today and other mainstream outlets.

Avenatti asked the accuser to go on Anderson Cooper 360, but she said she was afraid of men. He then offered the alleged accuser $20,000 for a one-on-one interview with Poppy Harlow of CNN, and finally $75,000.

Eventually, a third accuser made graphic allegations about high school parties that Brett Kavanaugh supposedly attended, but without any specific accusation based on personal knowledge of any wrongdoing against Kavanaugh himself. One enormous flaw in this third allegation: 60 classmates of Kavanaugh have signed a letter saying they have never met this woman who claims she was at all these parties.[102] Many other inconsistencies and credibility issues arose.[103][104] For example, she was revealed to have been in later college years while Kavanaugh was in his early high school years.[105] The New York Times tried but failed to corroborate the allegation.[51] It was soon discovered that the accuser had a troubled past,[106][107] and she had sued one of her employers for "sexual harassment" using Ford's lawyer's firm.[108][109] She was sued in 2000 for making false sexual misconduct allegations.[110][111]

As with the previous allegations, dozens of women rallied to Judge Kavanaugh's defense, with sixty of them signing a letter affirming he had a good character in high school.[112]

Observers noted that "Michael Avenatti managed to make it all about him."[113]

The New York Times did an article of Judge Kavanaugh's high school yearbook, but they did not mention that it was supplied from an outspoken and severely anti-Trump politician from Maryland, and it hid other important facts in the story.[114][115] Avenatti, using his 4chan troll sources, claimed to be able to "decipher" comments in the yearbook.[116]

Later, in an NBC interview, Swetnick contradicted the main points of her accusation, stating this time that she did not actually see Kavanaugh "spike punch" despite originally saying she had a "firm recollection" that he did.[117][118]

Leftist response

Chronicle Herald political cartoon smear

Canadian liberal newspaper The Chronicle Herald, based in Halifax, Nova Scotia, weighed in with its take and opinion on the Kavanaugh confirmation with a slanderous and grossly inaccurate political cartoon in its September 29, 2018 edition that depicted a man attempting to rape Lady Justice, with the Republican Party logo appearing on the man's shirt cuffs.[119][120] The highly inflammatory, provocative and controversial cartoon was intended as an attack against Kavanaugh, the Republicans and men as a whole and was unsurprisingly retweeted by supportive liberal celebrities and other liberal media outlets, but ended up drawing a heavy amount of criticism against it on the newspaper's Twitter account, with commenters taking both the paper and the cartoon's artist, Bruce MacKinnon, to task for MacKinnon's slanderous accusation while he and the paper ignored that the Democrat Party itself, particularly Bill Clinton, has its own sordid history of assaults, sexual and otherwise, against women. One commenter who took issue with the cartoon responded by posting a modified version of the cartoon with the Democrat Party logo on the man's shirt cuffs instead,[121] correctly pointing out that party's history of its mistreatment of women.

Attacks on Kavanaugh children

Far-Left liberal cartoonist Chris Britt viciously attacked Judge Kavanaugh's 10-year-old daughter and her faith in a mocking cartoon which subsequently drew criticism against him on Twitter and Facebook, but also drew vicious, nasty and bigoted attacks against critics of the cartoon from deranged leftists posting in support of Britt.[122]

Death and castration of Republicans

Georgetown Prof. Carol Christine Fair tweeted during the hearings that Republican Senators on the Judiciary Committee,
"All of them deserve miserable deaths while feminists laugh as they take their last gasps. Bonus: we castrate their corpses and feed them to swine? Yes."[123]
