Kelly v. Pennsylvania (2020) is case in which congressional candidates and others challenged the legality under the Pennsylvania Constitution of mail-in voting.
The Commonwealth Court of Pennsylvania held in their favor on November 27, 2020, by declaring the mail-in votes cast in the 2020 Presidential election to be invalid. The following day the Supreme Court of Pennsylvania, which is controlled by Democrats, overruled the decision based on a procedural technicality (laches). The high court did not doubt the substantive aspects of the lower court ruling that mail-in voting violates the Pennsylvania Constitution.
