In Martinez v. California, 444 U.S. 277, 283-284, n. 7 (1980), the U.S. Supreme Court removed any doubt that state courts may entertain Section 1983 actions. The Court reserved the question whether state courts are obligated to entertain Section 1983 actions, but held that Congress has not barred them from doing so.
