National Practitioner Data Bank

The National Practitioner Data Bank (NPDB) is a nationwide database of adverse reports about physicians, as filed by hospitals and insurance companies.[1] It is used by hospitals in determining whether to grant privileges to physicians.
All actions for damages in connection with the NPDB are subject to immunity under HCQIA, unless a report is filed with knowledge of its falsity. HCQIA Section 11137(c) provides:
| “ | No person or entity ... shall be held liable in any civil action with respect to any report made under this subchapter ... without knowledge of the falsity of the information contained in the report. | ” |
Reporting of certain peer review actions is mandated by HCQIA. The NPDB Guidebook specifics what is reported in the NPDB.
