An affidavit is a voluntary, written, or printed declaration of facts, confirmed by oath of the party making it before a person with authority to administer the oath.
Federal law enables one to do an affidavit without obtaining notarization, by signing a declaration in conformance with 28 U.S.C. § 1746.
New York State law, NY CLS CPLR R 2106, enables its attorneys, physicians, osteopaths and dentists, if not a party to the case, to subscribe and affirm a statement as true under the penalties of perjury, as a substitute to having it notarized as an affidavit.
