In NEA v. Finley, 524 U.S. 569, 587-588 (1998), the U.S. Supreme Court held that government is permitted to "allocate funding according to criteria that would be impermissible were direct regulation of speech or a criminal penalty at stake."
The Court upheld anti-pornographic restrictions on governmental funding of the arts.
