Actually, this image is not in the public domain, it is a copyrighted photograph from Associated Press. Yes it was taken by Joe Rosenthal but even WP had to get permission for it to be used on their site. I'm sure AP would not withhold permission for educational purposes but even so, credit to Joe Rosenthal & AP should be given in all instances, including thumbnail images. I think we have a good claim for fair use here, but in an abundance of caution perhaps we should ask Associated Press first. I'll take the image down pending AP comment on the rights to this famous photo.--Aschlafly 10:45, 19 April 2008 (EDT)

Karajou, your first link for justifcation is also in violation of copyright, the acompanying text says:

So the poster acknowledges that AP has rights over the image but incorrectly credits the National Archives. Although the images may have been obtained from a government web-site this does not mean that they are available for unrestricted or even fair use. Please see [3] for the actual conditions of use of the images. I'm sure AP would give permission but it should be obtained first. KTDiputsho 13:18, 19 April 2008 (EDT)

Although I disagree with you concerning its copyright status, you did raise a valid argument about the need to know. I sent an email to the Associated Press, and will pass along the results as soon as I get it. The photo as it stands will be considered copyright until then. Karajou 00:25, 20 April 2008 (EDT)

I received the following from Jack Green, a historian for the U.S. Naval Historical Center:

"Since Joe Rosenthal was working for the Associated Press at the time the photo is copyrighted to them, and they have the original negative. The AP granted a limited license to the U.S. Government to use the photo for the 7th War Loan in 1945."
