Kansas Aug. 2 Amendment Nothing in state constitution creates a right to abortion or requires funding of it, and the state legislature may pass pro-life laws
Kentucky Nov. 8 Amendment Nothing in state constitution creates a right to abortion or requires funding of it
Montana Nov. 8 LR-131 protects all infants born alive and requires medical care for them, declaring them to be legal persons
Vermont Nov. 8 Proposal 5 amends the state constitution to create a new right to personal reproductive autonomy, a code term for abortion

Other states that passed pro-life amendments to Constitution

Four other states had passed pro-life ballot initiatives which prohibit judicial interpretation of their state constitutions to authorize abortion, as of July 2022:

  • Tennessee (2014), overruling the ruling by the Tennessee Supreme Court in Planned Parenthood v. Sundquist (2000)
  • Alabama (2018)
  • West Virginia (2018), overruling the ruling by the West Virginia Supreme Court in Women’s Health Center v. Panepinto (1993) (requiring funding of abortion by Medicaid)
  • Louisiana (2020)
