California State Legislature

Legislative power in California is invested in a State Legislature composed of two houses, the California State Assembly (80 seats) and the California State Senate (40 seats). The structure and powers of the Legislature are set forth in Article IV of the California Constitution.

As of January 2021, for the 2021-22 session, the breakdown by parties was 31 Democrats and 9 Republicans in the State Senate, and 60 Democrats, 19 Republicans, and 1 Independent in the State Assembly.[1]

Vacancies are governed by Article IV, Section 2(d) of the California Constitution, and are ordinarily to be filled by the governor acting within 14 days to call a special election.[2]
