Conspiracy to commit mail fraud

A conspiracy to commit mail fraud is a federal crime consisting of three elements:[1]

  • (1) an agreement between defendant and others
  • (2) to commit the crime of mail fraud, and
  • (3) an overt act committed by one of the conspirators in furtherance of that agreement.
