The Fair Work Commission is the government of Australia's national agency for handling grievances relating to employment discipline and firings. Its goal is to create fair workplaces and to resolve disputes and dismissals.
Unlike in the United States, where private-sector employers can typically fire an employee without warning and for any reason, Australia enacted a series of laws in 2009 and subsequently which limits the ability of private employers to fire employees. Even small businesses in Australia are required now to:[1]
| “ | give the employee a reason why he or she is at risk of being dismissed. The reason must be a valid reason based on the employee's conduct or capacity to do the job. The employee must be warned verbally or preferably in writing, that he or she risks being dismissed if there is no improvement. | ” |
The Fair Work Commission, also known as "Fair Work Australia," handles grievances by employees against employers when there are violations of the workplace fairness statutes.
