In Hayes v. Gulf Oil Corp., 821 F.2d 285 (5th Cir. 1987), the Court of Appeals for the Fifth Circuit held that the failure of a lessee to raise a defense of improper venue in its first pleading or in a pre-pleading motion did not prevent the court from holding that it lacked subject matter jurisdiction over the lawsuit.
