In Loretto v. Teleprompter Manhattan CATV Corp., 458 U.S. 419 (1982), the U.S. Supreme Court held that when the government appropriates part of a rooftop in order to provide cable TV access for apartment tenants, it is required to pay for that share no matter how small.
Justice Thurgood Marshall wrote this opinion for the Court, and was joined by the conservative Justices and by Justice John Paul Stevens. Justices William Brennan, Harry Blackmun and Byron White dissented.
