As I understand, foreign diplomats are subject to a foreign power (i.e. not ours), therefore, According to the Civil Rights Act of 1866, birthright citizenship would not apply to their children. BradB 23:54, 27 April 2011 (EDT)

Seems to me the argument hinges on the phrase "subject to the jourisdiction thereof" which impliee a willingness on the part of the individual to subject themselves to the jourisdiction of the state, not a blanket imposition by the state over all inhabitants. Inhabitants who do not subject themselves, i.e. criminals who willfully disrespect and violate law, forfeit their rights under the law. And child lack capacity.

"Subject to the jourisdiction" is a two-way street. RobSDeep Six the Deep State! 13:57, 31 October 2018 (EDT)
