Posniak was submitted to the Tyding's Committee by McCarthy as Case Number 77. An F.B.I. agent and an F.B.I. informant reported that Posniak was a member of the Communist Party. On November 15, 1950, the State Department contacted the Loyalty Review Board that Posniak "elected to resign rather than accept suspension pending investigation and adjudication of certain charges bearing loyalty."
