Different states have different laws reguarding the status of people who have had sex change operations.  Generally, their birth certificates are reissued with their new gender. Since they are not required to divorce before surgery, this could lead do de-facto [[same sex marriage]] if they stay with their spouse.

Although transsexuals are not required to divorce before surgery, transsexuals married under their birth sex in states that do not allow [[same sex marriage]] are required to divorce before receiving legal recognition of their gender.  In most states it is possible for a transsexual person to remain in, or enter, an apparent [[same sex marriage]] only if it will be legally considered to be a heterosexual marriage.
