Groves was previously involved with the census bureau from 1990 to 1992, where he was associate director of statistical design.  Favoring the use of sampling in the census, Groves direction of the census may be unconstitutional under the [[Actual Enumeration]] requirement of Article I.

United States House of Representatives'', 525 U.S. 316 (1999) ruled that sampling cannot be used in redistricting during a census.  Although Groves claims he will not use sampling, it is likely he will attempt to use other tricks in 2010.
