Tucker Act

The Tucker Act, 28 U.S.C § 1491, § 1346(a)(2), waives sovereign immunity by the United States government for certain claims, and establishes a procedure for bringing those claims in the U.S. Court of Claims.

There is also the "Little Tucker Act" and the "Indian Tucker Act" for additional causes of action as specified in those statutes. More general waivers of sovereign immunity by the federal government are set forth in the Administrative Procedure Act, 5 U.S.C. § 500 et seq.; the Federal Tort Claims Act, 28 U.S.C. § 1346; and the Westfall Act, 28 U.S.C. § 2679.
