Criticism surrounding the United Nations Human Rights Council’s (UNHRC) Independent International Commission of Inquiry (COI), chaired by former UN High Commissioner for Human Rights Navi Pillay, has intensified due to allegations of systemic institutional bias, personal partiality of commissioners, and the commission’s accusations that Israel committed acts of genocide. Critics, including Israel, the United States, and legal experts, argue that the COI lacks the neutrality required of an international fact-finding body.

Accusations of Personal and Institutional Bias

Navi Pillay — Allegations of Prejudgment and Lack of Impartiality

Navi Pillay’s appointment as chair of the COI has drawn sustained criticism from Israeli officials and allied democracies, who argue that her extensive record of public statements regarding Israel demonstrates a predetermined ideological position rather than judicial neutrality.

Pillay has repeatedly characterized Israel as an “apartheid state” and publicly supported international boycotts, divestment, and sanctions (BDS) initiatives, positions critics argue are incompatible with leading an impartial inquiry.[1]

Organizations, point out that Pillay’s prior activism and advocacy against Israel violate UN standards requiring independence and objectivity in fact-finding missions.[2]

In October 2025, Pillay propagated that Israel was responsible for “four genocidal[sic] acts” in Gaza. Israeli officials and legal experts rejected the accusation as legally unfounded and politically motivated, asserting that it ignored genocidal Hamas’s documented war crimes and use of civilian infrastructure.

Miloon Kothari — Antisemitic Remarks and Ideological Predisposition

Former COI commissioner Miloon Kothari became a focal point for accusations of bias following remarks widely condemned as antisemitic and delegitimizing toward Israel.

In 2022, Kothari stated that social media was “controlled largely by the Jewish lobby,” prompting condemnation from governments and Jewish organizations.[4]

Kothari also questioned Israel’s legitimacy as a member of the United Nations, reinforcing concerns that the commission’s findings were ideologically predetermined.[5]

Although Kothari later issued an apology, Israeli officials dismissed it as insufficient and stated that his continued participation irreparably damaged the COI’s credibility.[6]
