Seems to me the argument hinges on the phrase "subject to the jourisdiction thereof" which impliee a willingness on the part of the individual to subject themselves to the jourisdiction of the state, not a blanket imposition by the state over all inhabitants. Inhabitants who do not subject themselves, i.e. criminals who willfully disrespect and violate law, forfeit their rights under the law. And child lacks capacity.
