Seems to me the argument hinges on the phrase "subject to the jourisdiction thereof" which impliee a willingness on the part of the individual to subject themselves to the jourisdiction of the state, not a blanket imposition by the state over all inhabitants. Inhabitants who do not subject themselves, i.e. criminals who willfully disrespect and violate law, forfeit their rights under the law. And a child lacks capacity.
