Transgender litigation has blocked conservative laws against transgender operations in children in these states:

  • Alabama
  • Arkansas
  • Florida
  • Indiana
  • Kentucky
  • Tennessee (the law was reinstated on appeal by a 2-1 decision of the Sixth Circuit)

Title IX litigation

A motion was filed in May 2024 in the Sixth Circuit to block Biden's new Title IX regulations from taking effect, which require allowing biological boys and men to compete unfairly in female sports if the males self-identify as transgenders:

"The Biden administration’s radical redefinition of sex will upend the equal opportunities that women and girls have enjoyed for 50 years under Title IX and will threaten their safety and privacy at every level," ADF senior counsel Rachel Rouleau said in a statement.[1]

Challenge to Connecticut Allowing Transgender Boys into Girls Sports

In December 2023, an en banc sitting of the Second Circuit reinstate a lawsuit by several cisgender girls against unfair competition by biological boys in sports competitions, as allowed by Connecticut policy.[2]
